Almost every aspect of commercial as well as domestic activities are directly or indirectly related with Intellectual Property Rights. The development and progress of science and technology is also related with the IPRs and this development is further related with the economic aspect of human life. In this book, the author has attempted to analyse the availability and availability of general as well life saving patented medicines to the general people of the country. At one hand, there is a need of patent protection and at the same time, there is need of making the necessary medicines on affordable price to the poor people. Basically, investments in R&D in the drug industry are very high as compared to its total sales. Also, there is a high cost attached to the risk of failure in pharmaceutical R&D with the development of potential medicines that are unable to meet the stringent safety standards, being terminated, sometimes after many years of investment. However, in pharmaceutical industry IPR is unjustifiably strengthened and abused at the expense of competition and consumer welfare. The lack of risk and innovation on the part of the drug industry underscores the inequity that is occurring at the expense of public good. The author has attempted to analyse the patent system of pharmaceuticals and patentability of life saving drugs on the affordable cost to poor. There is a need to make balance in profitability in pharmaceutical sector and availability of drugs to needy people for overall good of the society. This book will be beneficial to the law students in understanding the need of patent and its extent of protection in pharmaceutical industries along with efforts to ensure its availability to the poor people of the country. Efforts are made by the author in this book to analyse and understand the need of affordability and accessibility of the patented drugs to the poor people. The author is assured that the book will be helpful to the students of law and others who are interested to enhance knowledge in IPRs and to understand the role of IPRs in market economy.
